General Negligence
Who or what caused the injury is the first question that comes to mind whenever one encounters an accident.
If you are a victim of an accident, having to deal with this query is far from your mind. Instinct will tell you to seek medical attention immediately.
We, at Mesriani Law Group, are willing to take the burden of knowing the cause of the accident and filing the necessary claim to compensate your injuries.
We handle cases with fervor and commitment. Our long years of experience in litigation have made a mark in the legal community.
What is negligence?
Broadly speaking, negligence is carelessness. In its strict sense, negligence is a “conduct that is culpable because it falls short of what a reasonable person would do to protect another individual from foreseeable risks of harm.”
Elements of Negligence
The fact that you are injured will not automatically entitle you to compensation.
Only when all the elements below are alleged and proved that a plaintiff is entitled to claim for damages:
- defendant has a duty in the circumstances to take care (duty of care)
- behavior or omission of the defendant did not meet the standard of care which a reasonable man would observe in the circumstances (breach of duty)
- plaintiff has suffered injury or loss which a reasonable person in the circumstances could have been foreseen (damage)
- damage was caused by the defendant’s breach of duty (causation)
